ICBC Injury Caps to Injure BC Residents More

The aftermath of an auto accident can be a stressful time for all involved, but one thing you should NOT be worrying about during this time is money.  How are you going to make up for lost time at work? How are you going to take care of medical expenses? How are you going to repair your car? Will I be treated fairly and properly compensated by ICBC for the injuries and the impact on my life?  These are questions that you shouldn’t have to ask.

ICBC and the BC Government is trying to force an unfair law that WILL NOT treat you fairly and WILL NOT compensate you properly.  ICBC and the BC Government have announced that they want to cap ICBC claims at $5,500 for ALL pain and suffering on minor injuries. Make no mistake about it: this is going to ultimately injure British Columbia residents in a wide range of different ways that are more than worth exploring.

The Dangers of Injury Caps

The most important thing to understand about ICBC injury caps is that they’re not just bad for insurance rate payers and vehicle owners that are injured in accidents  – they also punish pedestrians, children, cyclists, and elderly people that may never have paid insurance premiums or no longer pay insurance.

Everyone is a little bit different and one person will heal differently from the next, even if they’ve sustained the same type of injury in roughly the same way. This is a cold, hard fact – yet it’s one that ICBC seems willfully ignorant of by capping pain and suffering claims on minor injuries at just $5,500.

Keep in mind that even ICBC admits that the average payout for these types of claims in 2016 was $16,500.  These payouts are based on what impartial Courts, Judges and Juries, after seeing all of the evidence, decided what was fair.

Not only that, but the idea of ICBC injury caps saving you money on your auto insurance is an absolute myth. Not only is there no evidence to suggest that this will actually happen, but when you consider that the amount of money that you DO receive will likely fail to actually cover the money you’ll need to pay to take care of ongoing medical expenses, your losses may be far greater than you likely even realized.

Joining a group to come out against ICBC injury caps on social media or posting a lengthy message will certainly help show officials that we do NOT want these caps – but this should only be the beginning of a much larger story.
